Terms & Conditions
- These terms and conditions shall apply to all trading between us and the customer and no variation of these conditions shall be binding on us unless otherwise agreed by us in writing.
- We reserve the right to refuse to execute any order or part order or contract if in our opinion the arrangements for payment are not satisfactory to us.
- Interest at the rate of 4% per annum above the current National Westminster Bank base rate shall be payable in respect of sums overdue.
- The customer shall not be entitled to withhold payment of any amount payable by reason of any dispute or claim by the customer in connection with any sale, and in the case of any short delivery of damaged goods, shall remain liable to pay the full invoice price of all other goods delivered or available for delivery.
- The cost of representing cheques shall be borne by the customer.
- A deposit of 50% of the overall cost of the quotation (materials/goods/labour) to be supplied is payable upon agreement.
- Delivery of the goods and a start date for the installation will be arranged at a mutually convenient date and time. Please note that no liability is accepted for any loss arising from delay in delivery of goods or non- delivery due directly or indirectly to industrial dispute, fire, act of state, force majeure or other circumstances beyond our control.
- The customer shall pay all sums due on delivery prior to unloading of any goods.
- The customer shall either themselves or by their duly signed authorised representative, sign, date and legibly write signatory's name on our receipt note as acknowledgement of delivery.
- If the customer wishes to claim that there is any shortage or delivery in respect of goods or materials supplied by us (or that the same have been damaged in transit or that any goods or materials supplied by us are defective or not in accordance with the contract), they shall record the same on the delivery ticket at the time of delivery and shall give notice in writing to us within 24 hours after the date of delivery of the same. If the customer fails to give such notice and fails to give us the opportunity to inspect the consignment, the goods or materials shall be deemed to have been delivered and to be in accordance with our contract in all respects.
- Any outstanding monies are payable on the last day of completion of the work Please note that post-dated cheques will not be accepted.
- Please note that at least two week's notice is required to accommodate any changes requested by the customer, including additional work to the agreed quotation .We reserve the right to require payment of a deposit with the order.
- Orders placed must be cancelled by customers in writing and we reserve the right to make a cancellation charge in any event.
- Orders for materials or goods to be made or cut especially to the customer's requirements cannot be cancelled.
- We cannot undertake to accept on return for credit any goods ordered from us incorrectly or found to be surplus to requirements. However we shall endeavor to assist our customers where possible by accepting at a reasonable restocking charge the return of goods which are normal stock lines, once prior agreement has been obtained, and restocking charges mutually agreed. Goods must be returned in unopened original packaging.
- Goods manufactured to the design or specification of the customers or their experts carry no undertaking of any kind except compliance with the design or specification agreed in writing.
- In the event that we are unable to complete the work agreed in the time allocated due to delays arising from building work being carried out by customer’s contractors or delays in obtaining merchandise from customer’s suppliers, a new mutually convenient installation date will be agreed.
- In the event that the pre-arranged delivery of goods cannot be accepted by the customer on the agreed date, and for any reason delivery from the manufacturer cannot be postponed, goods will be diverted for storage with a reputable warehousing agent and the charges will be borne by the customer.
- Murano House products are guaranteed for one year against faulty workmanship. If any workmanship is found to be defective in any way within the first year from the date of purchase, we or our authorised agents will replace that item without any charge for materials, labour or transportation. This guarantee does not cover misuse of furniture/appliances supplied or failure of components malfunctioning of electrical apparatus supplied by customers. This guarantee is available only to the original purchaser of the merchandise service. If it is found that the problem is due to anything other than that covered by the guarantee then the call out and inspection cost must be paid for by the customer plus postage and packaging as well as all repair charges.
- All equipment/merchandise supplied by us carries the manufacturers' own individual guarantees. The Customer will comply with the requirements of the supplier as to registration of purchase of any equipment (without Limitation of Statutory rights) use servicing and maintenance thereof.
- We will not accept liability arising from faulty or defective design when that design is undertaken separately either by the customers or their experts, and not as part of the overall installation contract, unless a survey of the premises where the work to be carried out is undertaken by us separately from the initial consultation.
- Goods or materials supplied will be replaced or repaired free of charge or in our absolute discretion the purchase price refunded if we are satisfied that they were defective in materials or workmanship on delivery and notice of the defect was given to us within 14 days of delivery and the goods returned to our shop carriage paid. We accept no liability as to the cost of taking out, re-fixing or making good other materials and the customer shall hold us fully and effectually indemnified in respect of any claim of any person in respect of such or any other consequential loss or damage.
- Our total liability for all loss or damage claimed to result from any breach of our obligations hereunder shall be limited to the customer's actual money damages, which shall not exceed the contract price of the goods/services.
- Our guarantees do not cover failure of any furniture components, or malfunctioning of electrical apparatus or any other goods supplied by customers. In the event of disputes relating to failure of appliances supplied by the customer, an independent assessment will be arranged to determine the cause of failure and responsibility for repair.
- The ownership of the goods/services sold by us to the customer shall remain with us until the customer has paid the price. We may at any time if any part of the said price shall remain outstanding, recover and resell all or any goods delivered to the customer.
- The risk in the goods shall pass to the customer on delivery or collection.
- The statutory rights of the consumer as to the quality, fitness or description of goods are not affected by these conditions of sale.
- All points of sale and display samples of the product will remain the property of Murano House until returned to Murano House or until fully paid for by the agent/distributor /retailer. Murano House has the right to recall any such displays samples of the product at any time.
